LOUISVILLE MAN CHARGED WITH RECEIVING AND POSSESSING CHILD PORNOGRAPHY

LOUISVILLE, KY - A federal grand jury in Louisville, returned an indictment on August 22, 2007, against Daniel Joseph Guenther, age 42, of Louisville, Kentucky, in Jefferson County, on charges of receiving child pornography via the Internet and possession of child pornography, U.S. Attorney David L. Huber of the Western District of Kentucky announced today.

The Indictment alleges that on or about December 18, 2005, Guenther received visual depictions over the Internet, via computer, which involved the use of a minor engaging in sexually explicit conduct, and which visual depictions were of such conduct. The Indictment further alleges that on or about February 11, 2007, Guenther possessed matters which contained visual depictions that had been shipped and transported in interstate commerce, including transmission over the Internet via the computer, which involved the use of a minor engaging in sexually explicit conduct, and which visual depictions were of such conduct.

In the event of a conviction, the maximum potential penalties are 60 years imprisonment, a $500,000 fine, and supervised release for a period of any term of years up to life; and the minimum potential penalties are 15 years imprisonment.

The case is being prosecuted by Assistant United States Attorney Madison T. Sewell, and it was investigated by the Federal Bureau of Investigation and the Louisville Metro Police Department, Crimes Against Children Unit.

This case is being brought as part of Project Safe Childhood. In February 2006, Attorney General Alberto R. Gonzales created Project Safe Childhood, a nationwide initiative designed to protect children from online exploitation and abuse. Led by the United States Attorneys Offices, Project Safe Childhood marshals federal, state and local resources to better locate, apprehend, and prosecute individuals who exploit children via the Internet, as well as identify and rescue victims.
